Keystone Custom Homes alleges Hearthstone Homes unlawfully used copyrighted design

ALLENTOWN – A Lancaster homebuilder alleges that a Wyomissing builder unlawfully used one of its home designs.

Keystone Custom Homes Inc. filed a complaint on Nov. 15 in the U.S. District Court for the Eastern District of Pennsylvania against Hearthstone Homes Inc. and Christopher J. Naso alleging copyright infringement.

According to the complaint, the plaintiff alleges that it registered its architectural designs titled "Samson" with the U.S. Copyright Office. It alleges that the plans were completed in 2005.

The plaintiff holds Hearthstone Homes Inc. and Naso responsible because the defendants allegedly built and sold at least one home using the plaintiff's design without authorization.

The plaintiff requests a trial by jury and seeks judgment against the defendants for damages of more than $150,000, profits, injunction against the defendants from further infringing plaintiff's designs, interest, court costs and any further relief the court grants.
