Velocity Magnetics Inc. seeks declaration of ownership of trade secrets, patent application

PITTSBURGH – A New Castle corporation is seeking declaration from the court regarding the ownership of trade secrets and a patent application.

Velocity Magnetics Inc. filed a complaint on Nov. 20 in the U.S. District Court for the Western District of Pennsylvania against Nidec Industrial Automation USA LLC, Nidec Corp., Emerson Industrial Automation USA Inc. and Control Techniques Americas LLC seeking declaratory judgement of ownership of patent applications and other counts.

According to the complaint, the plaintiff and defendants previously worked together on a project.

The plaintiff holds Nidec Industrial Automation USA LLC, Nidec Corp., Emerson Industrial Automation USA Inc. and Control Techniques Americas LLC responsible because the defendants allegedly failed to return all trade secrets of the Launching trade secrets upon their departure from the plaintiff's facility. The plaintiff also alleges that the defendants have also asserted they are the owners of the '476 application.

The plaintiff requests a trial by jury and seeks declaration that the plaintiff is the sole owner of the '476 application, declare that the plaintiff is the sole owner of the Launching trade secrets, exemplary damages, interest, court costs and any further relief this court grants.
