PHILADELPHIA – An adult motion picture owner alleges an unknown individual residing in the court's district has unlawfully distributed its movies.

Strike 3 Holdings LLC filed a complaint on Nov. 17 in the U.S. District Court for the Eastern District of Pennsylvania against John Doe subscriber assigned IP address 72.94.172.58 alleging copyright infringement.

According to the complaint, the plaintiff alleges that it was damaged from having 46 of its motion pictures distributed without its consent.

The plaintiff holds John Doe subscriber assigned IP address 72.94.172.58 responsible because the defendant allegedly used the BitTorrent software to download and distribute plaintiff's motion pictures. It alleges it has used geolocation technology to track the IP address to physical location in the court's district.

The plaintiff requests a trial by jury and seeks enjoin the defendant from further infringing plaintiff's copyrighted works, order the defendant to delete and permanently remove digital files relating to the plaintiff, statutory damages, court costs and any further relief the court grants. They are represented by Andrew W. Bonekemper and Christian Moffitt of Fox Rothschild LLP in Blue Bell.
