Woman alleges Lincoln University of Commonwealth System of Higher Education wrongfully terminated her

PHILADELPHIA – An Oxford woman alleges she was terminated for using FMLA leave.

Tracy L. Beird filed a complaint on Nov. 27 in the U.S. District Court for the Eastern District of Pennsylvania against Lincoln University of Commonwealth System of Higher Education citing the Family and Medical Leave Act, the Americans with Disabilities Act and the Pennsylvania Human Relations Act.

According to the complaint, the plaintiff was employed by the defendant from 2001 to 2016. She alleges during the latter half of her employment, she requested intermittent leave to care for her husband and children's medical conditions. She alleges she also took FMLA leave from Dec. 7, 2015, to Jan. 18, 2016, to care for her carpal tunnel. She was terminated April 1, 2016, the suit states.

The plaintiff holds Lincoln University of Commonwealth System of Higher Education responsible because the defendant allegedly retaliated against the plaintiff by illegally terminating her and refusing to rehire her because she asserted her FMLA rights.

The plaintiff requests a trial by jury and seeks judgment against the defendant for compensatory damages, back pay, reinstatement, front pay, interest, damages, court costs, and any further relief the court grants. She is represented by Scott M. Pollins of Pollins Law in Swarthmore.
