Man claims defective design of WonderGel seat cushion caused second-degree burns

READING – A Trevose man alleges a gel seat cushion does not contain warnings of risks of burns when it is exposed to the sun.

Jeffrey Tihansky filed a complaint on Dec. 1 in the U.S. District Court for the Eastern District of Pennsylvania against Edizone LLC alleging strict liability, negligence and other counts.

According to the complaint, the plaintiff placed the defendant's WonderGel Roll-n-Go Seat Cushion onto his motor scooter before putting the scooter in his van in June 2016. The suit states that the WonderGel cushion was hot and the plaintiff did not feel the heat because of a medical condition when he used the scooter later, and as a result suffered second-degree burns on a part of his body.

The plaintiff holds Edizone LLC responsible because the defendant allegedly failed to warn of the danger of injury and burns and that the product was defectively designed to create a risk of serious injury when exposed to the sun.

The plaintiff seeks judgment against the defendant for compensatory and punitive damages of more than $75,000 plus interest and court costs. He is represented by James R. Radmore of The Radmore Firm PC in Philadelphia.
