PHILADELPHIA – An Arkansas corporation and its sister company allege their supplements are being sold online without authorization.
Lecheek Nutrition Inc. and Retail Exclusive Distribution Inc. filed a complaint on Dec. 1 in the U.S. District Court for the Eastern District of Pennsylvania against New Health Ventures LLC, doing business as Elitenutrition.com and Nutritionalarsenal.com alleging trademark infringement.
According to the complaint, the plaintiffs produce and distribute dietary and nutritional supplements and own the Insane Labz mark. They allege the defendants have been selling Insane Labz supplements through their websites without authorization and continue to do so despite a cease and desist letter.
The plaintiffs request a trial by jury and seek damages that exceeds $5 million for compensatory damages, amount of $15 million for exemplary and punitive damages, court costs, enjoin the defendants and their agents from further infringing plaintiffs' trademark and any further relief the court grants.
