PITTSBURGH – A Pittsburgh man formerly employed by Coventry Health Care Inc. alleges his long-term disability benefits were wrongfully terminated after almost six years.
Harry Rattay filed a complaint on Nov. 27 in the U.S. District Court for the Western District of Pennsylvania against Hartford Life and Accident Insurance Co. alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff became disabled in 2010 due to multiple physical conditions and was approved for long-term disability benefits in October 2010. The suit states the defendant terminated the benefits in February 2016 allegedly because the plaintiff no longer met the definition of disability under its plan.
The plaintiff holds Hartford Life and Accident Insurance Co. responsible because the defendant allegedly failed to conduct a full and fair review of his claim.
The plaintiff seeks all relief he is entitled to under ERISA, interest, court costs and any further relief the court grants. He is represented by Brian Patrick Bronson of QuatriniRafferty P.C. in Greensburg.
