SCRANTON – A Hazleton landscaping and lawn care business alleges a West Hazleton company is unlawfully using its mark.
Deangelo Bros. LLC, formerly known as DeAngelo Bros. Inc., trading as Lawn Specialties filed a complaint on Dec. 8 in the U.S. District Court for the Middle District of Pennsylvania against Advanced Lawn Specialties LLC alleging trademark infringement.
According to the complaint, the plaintiff alleges that it has owned and traded under the Lawn Specialties name since 1982. The plaintiff states it sent a cease and desist letter to the defendant in May 2015 over the defendant's use of Advanced Lawn Specialties.
The plaintiff alleges that the defendant's use of the Lawn Specialties mark has caused confusion among customers.
The plaintiff seeks to enjoin the defendant and its agent from further infringing plaintiff's trademark, account for profits and actual damages, interest, punitive damages, court costs and any further relief the court grants.
