PITTSBURGH – A former employee of an electric utility alleges she and other employees were subjected to an illegal pay practice.

Linda Ewing filed a complaint on behalf of herself and all others similarly situated on Dec. 4 in the U.S. District Court for the Western District of Pennsylvania against First Energy Corp. alleging violation of the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and other counts.

According to the complaint, the plaintiff alleges that she worked for more than 40 hours per week as a field agent for the defendant but was not paid proper wages throughout her employment.

The plaintiff holds First Energy Corp. responsible because the defendant allegedly misclassified plaintiff as an independent contractor, only paid a daily rate and failed to pay overtime wages.

The plaintiff seeks unpaid back wages, liquidated damages, unpaid compensation, unpaid overtime wages, court costs, interest and any further relief the court grants. She is represented by Joshua P. Geist of Goodrich & Geist PC in Pittsburgh; Michael A. Josephson and Andrew W. Dunlap of Josephson Dunlap Law Firm in Houston, Texas; and Richard J. (Rex) Burch of Bruckner Burch PLLC in Houston.
