Man alleges A&E Construction terminated him in retaliation

PHILADELPHIA – A Warminster man alleges he was terminated from his job with an Upper Darby company after he took a medical leave.

Larry P. Kritz filed a complaint on Dec. 11 in the U.S. District Court for the Eastern District of Pennsylvania against A&E Construction Co. alleging violation of the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that he was terminated from his position with the defendant after taking a leave of absence beginning in May to undergo a kidney transplant. He alleges he was not informed of his FMLA rights before, during or after his leave of absence. The suit states he was terminated in August.

The plaintiff holds A&E Construction Co. responsible because the defendant allegedly retaliated against him for taking a leave of absence and discriminated against him based upon its perceptions of his health.

The plaintiff seeks judgment against the defendant for monetary damages equal to the amount of wages and benefits lost, liquidated damages, court costs, reinstatement, interest and any further relief the court grants.
