Centro Nueva Creacion alleges Goodlands of Kensington is using mark without authorization

PHILADELPHIA – A Pennsylvania nonprofit alleges an unregistered organization is unlawfully using its trademark.

Centro Nueva Creacion filed a complaint on Dec. 11 in the U.S. District Court for the Eastern District of Pennsylvania against Jessica Mendez, Madeline Neris Negron, Victor Negron, Jose Benitez and Eunice Sanchez, doing business as Goodlands of Kensington alleging trademark infringement.

According to the complaint, the plaintiff uses the Goodlands mark in connection with a photography and creative arts program for youth in Philadelphia. It alleges the defendants are unlawfully using its mark despite receiving plaintiff's requests to stop it.

The plaintiff requests a trial by jury and seeks enjoin the defendants from further using plaintiff's mark, court costs and any further relief the court grants. It is represented by Lynn E. Rzonca and Jenna M. Loadman of Ballard Spahr LLP in Philadelphia.
