PHILADELPHIA – A Philadelphia woman formerly employed by Sears Holding Corp. alleges her insurer wrongfully terminated her benefits.
Alma O'Neill filed a complaint on Dec. 13 in the U.S. District Court for the Eastern District of Pennsylvania against Life Insurance Co. of North America alleging violation of the Employee Retirement Income Security Act.
According to the complaint, the plaintiff alleges that in 2013, she became disabled due to having osteoarthritis and other medical problems and was initially receiving disability benefits from the defendant. The suit states in 2015, the defendant terminated her long-term disability benefits.
The plaintiff holds Life Insurance Co. of North America responsible because the defendant's denial of disability benefits allegedly is unreasonable and unsupported by evidence.
The plaintiff seeks declaration that she is disabled, order the defendant to pay long-term disability benefits to the plaintiff, payment of all benefits in arrears, order the defendant to pay disability benefits for as long as she remains disabled according to the policy, court costs, interest and any further relief the court grants.
