Woman seeks disability benefits from Life Insurance Co. of North America

READING – A Norristown woman alleges her disability benefits were wrongfully terminated.

Cassandra Carter filed a complaint on Dec. 18 in the U.S. District Court for the Eastern District of Pennsylvania against Life Insurance Co. of North America citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that she became disabled in 2014 because of degenerative disc disease of the lumbar spine and other medical conditions. She alleges she applied for disability benefits and received them from April 2014 to April 2015 before they were denied by the defendant.

The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly denied her a full and fair review of her claim.

The plaintiff seeks declare that the plaintiff is entitled to the payment of benefits under the long-term disability plan, declare that the defendant is estopped from denying plaintiff's benefits, payment of all past benefits due, court costs and any further relief this court grants. She is represented by Mary LeMieux-Fillery of Martin Law in Philadelphia.
