Former Black Diamond Investment Group employee alleges he is owed unpaid wages

PHILADELPHIA – A Philadelphia man alleges he is owed unpaid wages by his former employer.

Daryl Kofsky filed a complaint on Dec. 19, 2017, in the U.S. District Court for the Eastern District of Pennsylvania against Michael Salerno and Black Diamond Investment Group LLC citing the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment and Collection Law.

According to the complaint, the plaintiff was hired by the defendants in February 2017 as a senior recruiter and worked through October 2017. He alleges he worked 50 hours or more per week.

The plaintiff holds Salerno and Black Diamond Investment Group LLC responsible because the defendants allegedly failed to pay overtime premiums at a rate of time-and-one-half of his regular wage rate to the plaintiff for hours worked that exceeds 40 hours per week. He also alleges defendants often failed to pay him his promised weekly salary and bonuses.

The plaintiff seeks unpaid overtime wages, liquidated damages, interest, court costs and any further relief the court grants. He is represented by Peter Winebrake, R. Andrew Santillo and Mark J. Gottesfeld of Winebrake & Santillo LLC in Dresher.
