Aryzta LLC alleges it suffered more than $600,000 in damages because of food line contamination

WILKES-BARRE – The owner of a commercial bakery in Hazelton alleges some of its products were contaminated with metal chips after the installation of a catwalk at its facility.

Aryzta LLC filed a complaint on Dec. 20 in the U.S. District Court for the Middle District of Pennsylvania against Gottstein Corp. alleging negligence and breach of contract.

According to the complaint, in March 2016, the defendant installed a metal catwalk over food production lines at the plaintiff's facility and generated metal chips that fell onto the lines. The plaintiff alleges the metal chips contaminated food products that it withdrew from the market. The plaintiff alleges the damage from the contamination totaled $647,556.

The plaintiff holds Gottstein Corp. responsible because the defendant allegedly breached its duty to use due care while performing work at its facility.

The plaintiff seeks judgment against the defendant in the amount of $647,556 plus interest, court costs and any further relief this court grants. It is represented by Christopher H. Boyle of Cozen O'Connor in Philadelphia.
