PHILADELPHIA – A Hughesville, Maryland company is alleged to owe several thousand dollars to Newtown Square-based labor union funds.
Trustees of the National Elevator Industry Pension, Health Benefit, Educational, Elevator Industry Work Preservation Funds, Elevator Constructors Annuity and 401(k) Retirement Plan filed a complaint on Dec. 26, 2017, in the U.S. District Court for the Eastern District of Pennsylvania against Innovative Home Elevators LLC, doing business as Innovative Elevator Specialists LLC; Roxanne Granberry; and Stephen Lanham citing the Employee Retirement Income Security Act.
According to the complaint, Innovative Home Elevators entered into a collective bargaining agreement in March 2015 with the International Union of Elevator Constructors. The suit states that the plaintiff's auditor found that Innovative Home Elevators owes $2,444.76 for a period of March 2015 to July 2016. The plaintiff alleges an estimated $69,543.09 in contribution is owed for the period of August 2016 to October 2017.
The plaintiff seeks to enjoin the defendants, payment of unpaid contributions and any further relief the court grants. It is represented by Robert P. Curley and David D. Capuano of O'Donoghue & O'Donoghue LLP in Philadelphia.
