PHILADELPHIA – A therapist alleges her employer has misclassified her as an independent contractor and is owed unpaid wages.
Majuana Thompson filed a complaint on Jan. 8 in the U.S. District Court for the Eastern District of Pennsylvania against Progressions Behavioral Health Services Inc. and Progressions Cos. Inc. citing the Fair Labor Standards Act, the Pennsylvania Minimum Wage Act and the Pennsylvania Wage Payment and Collection Law.
According to the complaint, the plaintiff is currently employed by the defendants as a school-based outpatient therapist. She alleges she regularly works more than 40 hours per week.
The plaintiff holds Progressions Behavioral Health Services Inc. and Progressions Cos. Inc. responsible because the defendants allegedly failed to pay her any overtime premiums at 1.5 times her regular rate of pay for each hour worked more than 40 hours per week and failed to accurately tract and pay her for all hours worked.
The plaintiff alleges she is owed unpaid wages, overtime compensation and other benefits of employment.
