HARRISBURG – A York County man formerly employed as a deputy warden alleges he was constructively terminated after returning from a medical leave.
Michael P. Buono filed a complaint on Jan. 12 in the U.S. District Court for the Middle District of Pennsylvania against York County Prison Board, York County of Pennsylvania, Clair Doll and Emily Strickhouser citing the Family Medical Leave Act and the Rehabilitation Act of 1973.
According to the complaint, the plaintiff began his employment with the defendants in 1994 and his last position was deputy warden. He alleges he requested and was approved for FMLA leave from June 17, 2017, to Sept. 11, 2017, for a surgery on his hand. He alleges he returned from the leave early on Aug. 2, 2017, and was forced to resign that day.
The plaintiff holds York County Prison Board, York County of Pennsylvania, Doll and Strickhouser responsible because the defendants allegedly failed to restore him to his position following his leave and retaliated against him because of his use of FMLA leave.
The plaintiff seeks economic and/or actual damages, court costs and any further relief the court grants. He is represented by Jeremy Donham of Donham Law in Dellslow, West Virginia.
