HARRISBURG – A York County woman alleges she was terminated from her job with a grocery store chain in retaliation for needing a medical leave.
Debra A. Teal filed a complaint on Jan. 23 in the U.S. District Court for the Middle District of Pennsylvania against Giant Food Stores LLC and James Yenger alleging violation of the Family and Medical Leave Act.
According to the complaint, the plaintiff began her employment with the defendants in 1975. The suit states she was diagnosed with breast cancer in 2016 and took six weeks off for surgery related to the diagnosis. She alleges she requested time off for a reconstructive surgery that was scheduled in November 2017.
The suit states the plaintiff was terminated on Oct. 31, 2017, and she alleges she was terminated in retaliation for her request for FMLA leave for her surgery.
The plaintiff holds Giant Foods Stores LLC and Yenger responsible because the defendants allegedly interfered with her FMLA rights and discharged her employment without cause.
The plaintiff requests a trial by jury and seeks economic and actual damages, liquidated damages, court costs and any further relief the court grants. She is represented by Jeremy Donham of Donham Law in York, Pennsylvania.
