Roofer's improperly installed skylight led to condo unit's water damage, suit says

PHILADELPHIA – A Bucks County property rental company is taking a local roofing contractor to state court to recover financial damages connected to water mitigation repairs resulting from what it says was an improperly installed skylight.

Dynamic Rentals, LLC of Richboro filed suit in the Philadelphia County Court of Common Pleas on Jan. 25 versus C&G Contracting Co. Inc. (doing business as “P. Cooper Roofing”), of Croydon.

According to the suit, the plaintiff owns a condominium unit property on the 9700 block of Bustleton Avenue, as part of the Plaza Place Condominium Associations, Inc.

Prior to May 13, 2017, C&G contracted with the plaintiff to replace the roof of the building, and as part of the project, would likewise replace each unit’s bathroom skylight for an additional payment of $610, the suit says. Subsequently, C&G hired a third-party contractor to perform the repair work, including the replacement of both skylights at Unit 10, the suit says.

On May 13, 2017, a severe wind and rain storm took place in Philadelphia, resulting in damage to the condominium’s roof and water damage to Unit 10’s interior including the kitchen, living room, dining room, bedroom and bathroom, the suit says.

“As a result of the water entering Unit 10’s interior, plaintiff was required to hire a water mitigation company which removed the water-damaged drywall and insulation, and extracted water from the carpets. Plaintiff is required to perform repairs, including replacing the skylight, interior fixtures, drywall and carpet, and repainting the unit’s interior. Upon information and belief, the damage to Unit 10’s interior was a direct and proximate result of the improper specification and/or installation of the skylights, permitting water to enter the building through the skylight,” the suit states.

For breach of contract, the plaintiff is seeking damages in the sum of $25,155.43, with said amount not being in excess of $50,000, exclusive of interest, costs of suit as well as all other relief the Court deems just and proper.

The plaintiff is represented by Marc H. Edelson and Liberato P. Verderame of Edelson & Associates, in Newtown.
