PHILADELPHIA – A Washington, D.C. company is alleged to have failed to remit funds to Newtown Square-based benefit funds.
Trustees of the National Elevator Industry Pension Fund, et al. filed a complaint on Jan. 29 in the U.S. District Court for the Eastern District of Pennsylvania against United Elevator Co. LLC and Nicholas Irving citing the Employee Retirement Income Security Act.
According to the complaint, the plaintiffs allege that United Elevator Co. agreed to pay the plaintiffs certain sums of money for each hour worked by its employees per a collective bargaining agreement.
The plaintiffs holds United Elevator Co. LLC and Irving responsible because the defendants allegedly breached their bargaining agreement with the plaintiffs by failing to remit the entire amount of their monthly contributions on behalf of their employees in November and December 2017.
The plaintiffs seek that the court find that the defendants are liable in the amount of contributions, interest, liquidated damages, court costs and any further relief the court grants. They are represented by Andrew Kelser of O'Donoghue & O'Donoghue LLP in Philadelphia.
