State Farm Fire & Casualty Co. alleges negligence caused property damage from sinkholes

READING – An insurance company alleges a Hershey company's negligence caused two sinkholes that damaged its subrogor's property.

State Farm Fire & Casualty Co., as subrogee of John Machuzick, filed a complaint on Feb. 2 in the U.S. District Court for the Eastern District of Pennsylvania against Pennsylvania-American Water Co. alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 17, 2016, the Machuzick property in Reading was damaged due to the sinkholes caused by a water main that ruptured and leaked in August 2016. The suit states the water line was inspected, installed and maintained by the defendant.

The plaintiff holds Pennsylvania-American Water Co. responsible because the defendant allegedly carelessly and negligently maintained a properly functioning water main.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount of more than $150,000 plus interest, damages and any further relief the court grants. It is represented by Daniel J. de Luca of de Luca Levine LLC in Blue Bell.
