Sequoia Consulting Group Inc. alleged to have failed to contribute to man's 401(k) plan

PHILADELPHIA – A West Chester man alleges an Indiana-headquartered business has not made contributions to his 401(k) plan.

Eric B. Schnurer filed a complaint on Feb. 14 in the U.S. District Court for the Eastern District of Pennsylvania against David F. Lynn, Sequoia Consulting Group Inc., Karen Kinder and John Does citing the Employee Retirement Income Security Act.

According to the complaint, Sequoia Consulting Group Inc. acquired Public Works LLC, which was formerly owned and still headed by the plaintiff. The plaintiff alleges that the defendants have failed to pay sums owed to him and violated ERISA obligations.

The plaintiff holds Lynn, Sequoia Consulting Group Inc., Kinder and John Does responsible because the defendants allegedly failed to make the required contributions to his 401(k) account and the 4 percent match to his individual contributions.

The plaintiff seeks benefits due to him; declaration that the defendants have breached their duties; interest; require the defendants to provide books, documents and records relating to the finances and administration of the plan; punitive damages; court costs; and any further relief the court grants. He is represented by John S. Summers and Andrew M. Erdlen of Hangley Aronchick Segal Pudlin & Schiller in Philadelphia.
