Labor secretary alleges Reading day care center failed to pay overtime, minimum wage

ALLENTOWN – A Reading day care center and preschool is alleged to have failed to properly pay its employees.

Secretary of Labor for the U.S. Department of Labor R. Alexander Acosta filed a complaint on Feb. 27 in the U.S. District Court for the Eastern District of Pennsylvania against Little Hands Curious Minds LLC and Janneth Lopez alleging violation of the Fair Labor Standards Act.

According to the complaint, the defendants failed to pay employees for all hours worked and failed to pay overtime wages at a rate of time-and-one-half of employees' regular rates.

"Defendants also required employees to pay the cost of certain trainings. As a result of that uncompensated time and those improper deductions, defendants failed to pay employees the applicable minimum wage for all hours worked during some workweeks," according to the suit.

The plaintiff seeks to enjoin the defendants, unpaid minimum wage and overtime compensation, court costs, liquidated damages, and any further relief this court grants. He is represented by Solicitor of Labor Kate S. O'Scannlain, Regional Solicitor Oscar L. Hampton III and Regional Counsel Adam F. Welsh of Wage and Hour Office of the Solicitor, Region III in Philadelphia.
