Mutual Benefit Group seeks more than $100,000 from roofing company after rain damaged machines

PITTSBURGH – An insurance company alleges an Indiana roofing company is responsible for damages to video poker and video game machines damaged by rainwater.

Mutual Benefit Group, as subrogree of CBS Vending, filed a complaint on March 6 in the Court of Common Pleas of Allegheny County against Advanced Commercial Roofing alleging negligence.

According to the complaint, CBS Vending was covered under a commercial liability policy of insurance issued by the defendant. In July 2016, the suit states CBS rented storage space from STORExpress in McKees Rocks and in May 2017, 42 of the video poker and video game machines stored there were damaged by rain water. The suit states the water entered the storage facility through the roof during a storm and that the defendant had previously repaired and/or replaced the STORExpress roof.

The plaintiff holds Advanced Commercial Roofing responsible because the defendant allegedly failed to properly repair the portion of the roof, thus allowing rain water to enter the facility.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $101,594.06 plus interest and any further relief the court grants. It is represented by Thomas P. McGinnis and Jeffrey T. Criswell of Thomas, Thomas & Hafer LLP in Pittsburgh.
