Man injured in accident files bad faith suit against Nationwide Insurance Co., agency

PITTSBURGH – A West Mifflin man is seeking judgment regarding insurance coverage after he was injured while riding a motorcycle the same day he purchased it.

PITTSBURGH – A West Mifflin man is seeking judgment regarding insurance coverage after he was injured while riding a motorcycle the same day he purchased it.

Regis A. Dusch filed a complaint on March 9 in the Court of Common Pleas of Allegheny County against Joshua Michael Dott Agency and Nationwide Insurance Co. of America alleging bad faith, breach of fiduciary duty and other counts.

According to the complaint, the plaintiff purchased a motorcycle Oct. 17, 2017, and called Dott Agency regarding insurance for it before driving home. The suit states as he was driving home, a motor vehicle made a sudden turn in front of him and caused an accident that severely injured him. The plaintiff alleges he reported the accident to Nationwide the following day.

The plaintiff alleges he was entitled to stacking at the time of the accident and no rejection of stacking had been executed by him. He alleges he is entitled to stacked uninsured/underinsured motorist limits of $100,000 times four.

The suit states the defendants determined the plaintiff rejected stacking on his policy and will only offer $100,000 in coverage.

The plaintiff holds Joshua Michael Dott Agency and Nationwide Insurance Co. of America responsible because the plaintiff alleges he did not sign the purported rejection of stacking.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount of more than $35,000 plus interest, court costs and any further relief the court grants. He is represented by Thomas E. Crenney and Alicia R. Nocera of Thomas E. Crenney & Associates LLC in Sewickley.
