Default judgment sought in case involving ticket broker who supposedly owes $31K in fees

PHILADELPHIA – A Philadelphia-based broker’s failure to file an answer to a complaint filed by Connecticut-based ticket software agency connected to more than $30,000 for ticket orders it supposedly never paid for, has the plaintiff seeking a default judgment.

On April 27 of last year, TicketNetwork filed a praecipe for an entry of default against Home & Away Entertainment, Inc. in the amount of $31,562.11, for both those damages and a failure to respond to service of its complaint within 20 days, as prescribed by law.

TicketNetwork of South Windsor, Conn. first filed suit on Feb. 28, 2017 in the Philadelphia County Court of Common Pleas, against Home & Away Entertainment, Inc. (doing business as Wanamaker Entertainment Group) of Philadelphia.

Court records indicate the defendant received the suit on March 3, 2017.

“Plaintiff is in the business of acting as an intermediary software exchange that allows for the sale and purchase of tickets online and provides customer service on its sellers’ behalf,” the lawsuit stated.

According to the complaint, between July 20, 2016 and Aug. 6, 2016, Home & Away Entertainment accepted 76 ticket orders for various events, totaling $24,936.68. The plaintiff alleges Home & Away Entertainment failed to pay on each of these orders, and that sellers are responsible for paying a four percent late charge for invoiced amounts and attorney’s fees.

Based upon that failure, the plaintiff claims they are owed $989.04 for late charges and $4,467.37 for attorney’s fees, and further, that though demand was made for payment of the total inclusive amount of $30,393.09, the defendant refused to provide any or all of that price.

The plaintiff is now seeking damages of $31,562.11, plus annual interest at six percent from 30 days after each invoice date and the costs of this action, in this matter.
