PHILADELPHIA – Counsel for a Voorhees, N.J.-based supply company that claims a Philadelphia contracting firm owes it in excess of $26,000 for unpaid goods is now seeking a default judgment to that effect.
Per a praecipe filed by plaintiff attorney Derek Blasker on Feb. 6, American Builders & Contractor’s Supply Company, Inc. is seeking the aforementioned default judgment from GC Family Contractors, LLC for an amount of $26,633.77 for failure to file an answer to its complaint within the legally-required time period.
American Builders & Contractor’s Supply Company, Inc. (doing business as ABC Supply Co., Inc.) first filed suit in the Philadelphia County Court of Common Pleas on May 17, 2017 versus GC Family Contractors, LLC, in order to attempt to recover the outstanding balance amount.
According to the complaint, on Dec. 18, 2015, GC Family Contractors signed a credit contract with ABC Supply Co. for the regular supply of building and construction products for use in the defendant’s business. Per the terms of the contract, ABC Supply regularly delivered building and construction supplies to GC Family Contractors, which the defendant accepted.
ABC Supply alleges it sent invoices to GC Family Contractors for payment for the goods it delivered, but that the defendant has not paid the full balance. Pursuant to the terms of the credit contract, ABC Supply claims GC Family Contractors breached the agreement and is now liable to it for payment of the outstanding balance due, as well as for attorney’s fees and costs in the instant action – a sum the plaintiff claims the defendant has refused to pay.
The plaintiff is seeking damages of $26,633.77, plus the costs of the action in this matter. The actual damages are comprised of $23,386.03, inclusive of contractual interest, plus $3,247.74 in attorney’s fees and costs of suit.
