PHILADELPHIA — An individual is suing Credit Collection Services for alleged misrepresentation in debt collection.
Von Brooks filed a complaint on April 10 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendant violated the Fair Debt Collection Practices Act, the Pennsylvania Fair Credit Extension Uniformity Act and the Pennsylvania Unfair Trade Consumer Protection Law.
According to the complaint, the plaintiff alleges that he received a letter from the defendant seeking to collect debt on behalf of Thomas Jefferson Hospital after he allegedly filed for Chapter 7 bankruptcy and his debt was discharged.
As a result of the defendant's alleged actions, the plaintiff claims that he suffered mental anguish, emotional distress, anger, anxiety and frustration.
The plaintiff holds the defendant responsible for allegedly engaging in false, deceptive or misleading representation in an alleged attempt to collect discharged debt.
The plaintiff requests a trial by jury and seeks judgment for actual and treble damages, reasonable attorney's fees, costs and any further relief that the court deems just and proper. He is represented by Stephen M. Dunne of the Dunne Law Offices PC in Philadelphia.
