Assurant Inc. accused of firing employee for requesting FMLA-protected leave

SCRANTON — A former employee is suing Assurant Inc. and John Does for alleged wrongful termination and disability discrimination.

Carrie L. Bruaw filed a complaint on April 9 in the U.S. District Court for the Middle District of Pennsylvania, alleging that the defendants violated the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that she was discharged from work on Nov. 9 after filing for FMLA-protected leave due to injuries she allegedly sustained in a car accident on Jan. 17, 2017. Despite allegedly providing medical information and an explanation for her request, she allegedly was suspended and later terminated for allegedly violating company policy. 

The plaintiff holds the defendants responsible for allegedly firing her without cause, failing to follow normal procedures when processing a request for FMLA-protected leave and for allegedly failing to provide reasonable workplace accommodations.

The plaintiff requests a trial by jury and seeks judgment for economic and actual damages, liquidated damages, attorney's fees, expert fees, the costs of the suit and any other relief that this court deems just and equitable. She is represented by Jeremy Donham of Donham Law in Dellslow, W.Va.
