PHILADELPHIA — A motorist is suing two other motorists, Dermot J. Garrett and Donald M. Joseph, for allegedly taking insufficient measures to prevent injuries.
Collard E. Newland filed a complaint on April 27 in the U.S. District Court for the Eastern District of Pennsylvania, alleging that the defendants failed to maintain proper control of their vehicles.
According to the complaint, the plaintiff alleges that he had pulled over onto the right shoulder of a road when the defendants' vehicles allegedly collided with his vehicle. As a result, plaintiff claims that he has sustained serious injuries, suffered lost wages and incurred medical expenses. The plaintiff holds the defendants responsible for allegedly failing to be vigilant while driving.
The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount that exceeds $75,000, plus the costs of this action. He is represented by Peter D. Baron of Law Offices of Peter D. Baron PLLC in Melville, N.Y.
