Lawsuit: Insurance provider failed to cover wind, water damage at plaintiff's property

PHILADELPHIA – A North Wales plaintiff is pursuing claims of breach of contract and bad faith against Farmers Insurance, arguing that the provider failed to cover her for losses due to wind and water damage at her property.

Jayshree Boghara of North Wales filed suit in the Philadelphia County Court of Common Pleas on May 23 versus Farmers Insurance Exchange and Farmers Insurance, Inc. (both doing business as “Farmers Insurance”), both of Los Angeles, Calif.

Per the litigation, Farmers Insurance provided coverage for a property located at 129 Gwynmont Drive in North Wales, to offer protection from wind damage and water damage to the property. Such an incident did transpire on May 24, 2017 and the suit explains the loss was reported to Farmers Insurance.

“After repeated demands for payment from the defendant, the defendant continues to refuse payment of the related damages to said property. As of this date, defendant has continually refused to pay damages associated with plaintiff’s damage claims and, furthermore, has concluded that all damages to plaintiff’s property are not covered losses. Defendant accepted valid policy premiums from plaintiff so that coverage may be afforded in the event such as described above, has failed to fulfill their contractual obligations associated with the payment of said claim,” the suit states.

For counts of breach of contract, bad faith and common law bad faith, the plaintiff is seeking all contractual damages deemed payable to plaintiff, interest with those monies associated with the damage of said property, losses associated with the use and efficacy of plaintiff’s building, attorney’s fees and costs associated with the filing of this action and the litigation of this matter, plus all other relief the Court deems just and proper.
