At center of lawsuit from N.J. electric company is $80K bill for allegedly unpaid costs

PHILADELPHIA – A New Jersey electric company is pursuing legal action against a Philadelphia contractor for more than $80,000 in unpaid costs, according to a new lawsuit.

Franklin-Griffith, LLC (successor-in-interest to Franklin Electric Co.) of Moorestown, N.J. filed suit in the Philadelphia County Court of Common Pleas on May 22 versus Mark G. Hoyer Electrical Contractor, LLC (doing business as “M.G.H. & Associates”), of Philadelphia.

“At defendant M.G.H.’s request, plaintiff Franklin-Griffith sold and delivered to defendant certain electrical goods and/or materials. The subject electrical goods and/or materials were sold and delivered to defendant M.G.H., and the prices were correct, just and reasonable, the usual market price for the electrical goods and/or materials sold to defendant M.G.H. and, further, are the prices which the defendant agreed to pay,” the suit says.

“Defendant M.G.H. has received all credits to which defendant is entitled. Currently, the amount due and owing to plaintiff, Franklin-Griffith, from defendant, M.G.H. us $79,374.15, plus interest in the amount of one and one-half percent per month from April 30, in the sum of $714.36, interest and attorney’s fees. Despite repeated requests and demands, defendant M.G.H. has failed and refused to pay the amounts owed by defendant to plaintiff,” the suit adds.

For seven counts of breach of contract, the plaintiff is seeking damages of the principal amount of $79,374.15, pre-judgment interest as of May 16, of $714.36, plus accumulated pre-judgment interest from May 17 until the date of judgment, at the contract rate of one and one-half percent per month, costs of collection and attorney’s fees, post-judgment interest on the judgment amount at the contract rate of one and one-half percent per month until paid and such other and further relief as the Court deems just and equitable.

The plaintiff is represented by Vito C. DeMaio of Nord & DeMaio, in Toms River, N.J.
