PITTSBURGH — A religious organization is suing an insurer for alleged breach of a general comprehensive liability insurance contract.
Primitive Methodist Church in the United States of America filed a complaint May 25 in the Court of Common Pleas of Allegheny County against Brotherhood Mutual Insurance Co. and other defendants, alleging that the defendants breached their duty to defend the insured against all claims made in an underlying assault lawsuit until the conclusion of the case.
According to the complaint, despite timely notifying the defendants of the claim and cooperating fully with the investigation and litigation of the underlying case, the defendants issued a reservation right letter seeking to deny coverage to the church under the policy.
The plaintiff requests a trial by jury and seeks indemnification under the terms and conditions of the CGL policy, together with an award of costs and expenses, including attorney's fees and other relief that the court may deem appropriate.
