Best Buy and shopping plaza face negligence charges in state court lawsuit

PHILADELPHIA – A plaintiff claiming to have been seriously injured in the parking lot of a Philadelphia Best Buy store nearly one year ago, has brought legal action against the electronics retail giant and the shopping plaza where the store is located.

Nancy Lewis of Philadelphia filed suit in the Philadelphia County Court of Common Pleas on June 12 versus Best Buy, also of Philadelphia, and Red Lion MZL LP (doing business as “Red Lion Shopping Plaza, c/o Red Lion JV, LLC”) of Bethesda, Md.

On Sept. 1, 2017, Lewis was visiting a patron in the defendants’ above-mentioned parking lot at approximately 5 p.m. when she was caused to be injured as a result of a defect in said parking lot, the lawsuit says.

The lawsuit takes both Best Buy and the shopping plaza’s owner, Red Lion, to task for alleged negligence; for not properly maintaining the store’s parking lot, failure to inspect the premises adequately, failure to warn the plaintiff of a dangerous condition and failure to use due care under the circumstances, among numerous other charges.

According to the lawsuit, Lewis suffered an acute transverse extra-articular fracture at the base of the fifth metatarsal, on the right, and severe shock to the nerves and nervous system.

For negligence, the plaintiff is seeking damages in excess of $50,000.

The plaintiffs are represented by Lawrence G. Metzger of Metzger & Kleiner, in Philadelphia.
