Lender claims 5171 Campbells Land, owner failed to repay loan

PITTSBURGH — An Allegheny County resident is suing borrowers William Kane and 5171 Campbells Land Co. LLC for breach of contract.

Peter Kaplan filed a complaint May 31 in the Allegheny County Courts of Common Pleas, alleging that the defendants failed to perform their obligations under a loan agreement.

According to the complaint, the plaintiff agreed to lend Kane $125,000 in September as part of a bankruptcy court deposit and to bid on a chain of Perkins restaurants.

As of May 31, Kaplan said Kane had not repaid the amount due. He said he holds Kane and 5171 Campbells Land responsible because they allegedly refused, despite repeated demands, to repay the loan following a bankruptcy court auction held in January.

The plaintiff requests a trial by jury and seeks a judgment in the amount of $125,000, plus interest, costs and attorney's fees. He is represented by Joseph Hudak of Joseph Hudak Law Office in Pittsburgh.
