A shocking incident at a local grocery store has led to a legal battle that could have far-reaching implications for business accountability and employee safety. Janine Spiker, an employee of Giant Food Store, filed a complaint on May 5, 2025, in the Court of Common Pleas of Delaware County against Keenan Plumbing & Heating, LLC. The lawsuit stems from an alleged failure by Keenan's employees to properly clean up after completing plumbing work, resulting in Spiker sustaining severe injuries.
The case details reveal that on September 13, 2024, Keenan Plumbing & Heating was contracted to perform plumbing work at the Giant Food Store located at 225 Lancaster Avenue in Malvern, Pennsylvania. According to the complaint, Keenan's employees neglected their duty to clean the bathroom after completing their tasks. This oversight left standing water and debris in the bathroom area. A customer informed Spiker about the unsanitary condition of the bathroom, prompting her to investigate. Upon entering the bathroom, she slipped and fell due to the hazardous conditions left behind by Keenan's workers.
Spiker claims that Keenan Plumbing & Heating failed in its responsibility to ensure that the work area was safe for use after completing their job. The lawsuit accuses Keenan of negligence and carelessness for not cleaning up water and debris or warning individuals about these dangerous conditions. "It was the duty of Defendant, KEENAN," asserts Spiker in her complaint, "to leave said bathroom in a reasonably safe condition for its intended use." As a result of this negligence, Spiker suffered serious injuries including a traumatic tear of her left hamstring tendon and other permanent injuries that have caused ongoing pain and mental anguish.
In her legal filing, Spiker seeks judgment against Keenan Plumbing & Heating for an amount exceeding $50,000. She is pursuing compensation for medical expenses incurred due to her injuries as well as potential future costs related to ongoing treatment and rehabilitation. Additionally, she is seeking damages for lost wages due to her inability to work following the accident and any future impairment of earning capacity.
Representing Janine Spiker is attorney James M.P. Turner Jr., from Furia and Turner LLC based in Media, Pennsylvania. The case is being heard under Case ID filed with Delaware County's Office of Judicial Support.
