Customers claim WhisperKOOL unit could not hold proper temperature

PITTSBURGH — Two consumers are suing WhisperKOOL Corp., citing alleged fraud and deceit.

Jon R. Perry and Joni L. Perry filed a complaint June 5 in Allegheny County Courts of Common Pleas against, alleging that WhisperKOOL violated the Pennsylvania Unfair Trade Practices and Consumer Protection Law.

According to the complaint, the plaintiffs bought the defendant's wine cellar self-contained cooling unit on June 20. 2017 for $2,029. As a result of the defendant's misrepresentations, the plaintiffs allege that their wine cellar stocks were at risk of being destroyed by high temperature.

The plaintiffs said WhisperKOOL allegedly failed to provide a cooling unit that can maintain a 55-degree temperature, failed to properly examine and diagnose the problems with the unit and failed to repair the defects.

The plaintiffs request a trial by jury and seek compensatory damages in an amount within the jurisdiction of the court, plus interest, costs and counsel fees. They are represented by Michael Calder of Rosen Louik & Perry PC in Pittsburgh.
