Pedestrian claims he was hit by Upper Darby Police vehicle

MEDIA — A pedestrian is suing the Upper Darby Police Department, Officer Jeffrey Thrash and the Township of Upper Darby, citing alleged negligence that resulted in injuries.

Dalmeir Mitchell filed a complaint June 21 in the Delaware County Court of Common Pleas.

According to the complaint, Mitchell was walking on June 27, 2016 when he was allegedly hit by the police cruiser being driven by Thrash as he was entering an intersection. 

As a result of the accident, Mitchell claims he suffered bodily injuries and great pain and needed medical assistance. 

Mitchell alleges that Thrash failed to notice him walking in the intersection, failed to use turn signals and failed to operate his vehicle in accordance with existing traffic conditions.

The plaintiff requests a trial by jury and seeks a judgment in an amount in excess of $50,000, plus interest and costs. He is represented by Michael Hook of The Hook Law Firm PC in Eagleville, Pennsylvania.
