PHILADELPHIA — A leasing company is suing the City of Easton, citing alleged breach of contract.
LVL Co. LLC filed a complaint June 26 in the U.S. District Court for the Eastern District of Pennsylvania, claiming the city deprived the company of its property rights without just compensation or due process.
According to the complaint, LVL entered into a lease agreement with Easton on April 27, 2016 to allow for construction of a billboard next to Interstate 78.
The plaintiff claims the proposed site did not meet applicable federal regulations, but a proposed new site for the billboard was rejected by Easton, allegedly costing LVL more than $7.25 million.
The plaintiff requests a trial by jury and seeks a judgment for compensatory damages in the amount of $7,250,000, with delay, punitive damages, attorney's fees, costs and other relief the court deems appropriate. It is represented by James Pfeiffer of Pfeiffer & Bruno PC in Easton, Pennsylvania.
