Cheswick police chief files suit in wake of overtime dispute

PITTSBURGH — A police chief is suing Cheswick Borough for breach of contract.

Robert Scott filed a complaint June 26 in the U.S. District Court for the Western District of Pennsylvania, alleging that the borough violated the Fair Labor Standards Act by failing to pay overtime and retaliating against him.

According to the complaint, Scott began working for defendant in 1983 as a part-time officer and was promoted to full-time in 1987. He was named chief in 2009. 

Scott claims Cheswick breached his employment contract by stating publicly that he was dishonest or immoral, which seriously damaged his standing in the community and his future employment prospects. The lawsuit alleged that the borough also forced Scott to work overtime without pay and retaliated against him for trying to receive overtime pay. 

The plaintiff requests a trial by jury and seeks full back pay and benefits, pre-judgment and post-judgment interest, liquidated and compensatory damages, attorney's fees, costs of the lawsuit and other legal relief the court deems proper. He is represented by Christian Bagin of Weinand & Bagin in Pittsburgh, Pennsylvania.
