Estate executor accuses Manorcare Health Services - Whitehall of negligence

PITTSBURGH — A surviving nephew is suing Manorcare Health Services, citing alleged negligent supervision of residents.

John Micklo, executor for the estate of the late Regis McDonough, filed a complaint June 27 in the Court of Common Pleas of Allegheny County against Whitehall Borough - Pittsburgh, PA LLC, doing business as Manorcare Health Services, and others, alleging that the defendants breached their duty to provide adequate and appropriate medical, skilled nursing, rehabilitation, therapy and custodial care services and supervision to McDonough and other residents.

According to the complaint, McDonough allegedly did not receive the adequate care he needs because the defendants mismanaged and reduced staffing levels in an effort to maximize profits. As result, the plaintiff claims McDonough's health deteriorated, he was malnourished and he suffered injuries from falls and infections.

Micklo alleges that the defendants failed to ensure that the facility's residents were treated with dignity and respect by providing enough staffing and a safe, decent and clean living environment.

The plaintiff requests a trial by jury and seeks a judgment in an amount in excess of $50,000, together with punitive damages, costs and other relief that the court deems appropriate. He is represented by Ryan Duty of Wilkes & McHugh PA in Pittsburgh, Pennsylvania.
