Property owner blames Carbondale, sewer authority for damage to home

SCRANTON — A property owner is suing the City of Carbondale and the Lackawanna River Basin Sewer Authority, citing alleged breach of duty and negligence.

Robert Evancho filed a complaint July 17 in the Lackawanna County Court of Common Pleas, claiming that the defendants violated the Political Subdivision Tort Claims Act.

According to the complaint, Evancho's property suffered sewer-related damage during a rain storm on July 15, 2016, affected his living conditions as well as those of his tenants. 

Despite receiving pictures of the damages, Evancho said the defendants allegedly refused to fix the problem or reimburse him for out-of-pocket-expenses. 

Evancho said the defendants allegedly refused to remedy the overflow and back flow problems, forcing him to have two back flow valves installed to prevent further damages to his house.

The plaintiff requests a trial by jury and seeks a judgment in the amount of $160,192.80, plus punitive damages, an injunction and a resolution of the sewer overflow problem.
