Emma Chemicals files lawsuit alleging price-fixing conspiracy

PHILADELPHIA — Emma Chemicals Co. Inc. filed a class-action lawsuit against several manufacturing companies, citing alleged antitrust violations and unjust enrichment.

Lead plaintiff Emma Chemicals filed a complaint July 16 in the U.S. District Court for the Eastern District of Pennsylvania against BASF SE, BASF Corp., Bayer AG, Bayer Corp., Bayer MaterialScience LLC, Covestro LLC, Dow Chemical Co., Huntsman International LLC, Huntsman Corp., Mitsui Chemicals America Inc., Mitsui Chemicals Inc., Mitsui Chemicals & SKC Polyurethanes Inc., MCNS Polyurethanes USA Inc., Wanhua Chemical (America) Co. Ltd. and Wanhua Chemical Group Co., Ltd., claiming the defendants violated the Sherman Act and the Clayton Act.

According to the complaint, Emma Chemicals and the class members purchased products from one or more of the defendants, but the defendants allegedly conspired to fix the prices of the products in question. 

Emma Chemicals said the defendants allegedly conspired to limit the supply of methylene diphenyl diisocyanate and toluene diisocyanate in the market to raise the price and overcharge buyers.

The plaintiff requests a trial by jury and seeks damages, pre-judgment and post-judgment interest, costs of the lawsuit and other relief the court deems proper. It is represented by Linda Nussbaum, Bart Cohen and Fred Isquith Jr. of Nussbaum Law Group PC in New York.
