Son blames Oakleaf Personal Care Home for mother's death

PITTSBURGH — A surviving son and estate administrator is suing Oakleaf Inc., doing business as Oakleaf Personal Care Home, claiming insufficient measures were taken to prevent injuries.

Timothy Wrobleski, individually and as executor of the estate of Mardell Wrobleski, filed a complaint Aug. 1 in the Court of Common Pleas of Allegheny County, alleging that the nursing home breached its duty to provide ordinary and reasonable care to residents.

According to the complaint, on Jan. 19, 2015, Mardell Wrobleski was admitted to the defendants' facility because she frequently fell and needed a walker at all times and assistance with showers.

However during her stay at Oakleaf, her son claims she suffered numerous falls, complained of dizziness and sustained lacerations. Mardell Wrobleski died Dec. 12, 2016, and the complaint alleges that her death was attributable to complications from blunt force trauma related to a fall.

The plaintiff said Oakleaf allegedly failed to use proper preventative and/or safety measures and fall interventions and failed to formulate, adopt and enforce adequate rules, regulations, policies, procedures and protocols that would have ensured the safety of residents.

The plaintiff requests a trial by jury and seeks compensatory damages in an amount in excess of the jurisdictional arbitration limits, together with interest, costs of the lawsuit and any other relief the court deems appropriate.
