SCRANTON — A Lancaster, Pennsylvania, man has filed a lawsuit against Accuquest Hearing Center, alleging that the hearing facility fired him over his wife's diagnosis of pancreatic cancer.
Todd Aston is citing alleged disability discrimination and wrongful termination in a lawsuit he filed on July 27, in the U.S. District Court for the Middle District of Pennsylvania.
Aston claims that Accuquest violated the Americans with Disabilities Act.
Aston allegedly was informed by Accuquest that his employment was terminated after he told the company of his wife's cancer diagnosis.
Despite performing his job duties in satisfactory fashion, plaintiff claims defendant allegedly made the unfounded assumption that his wife’s diagnosis was going to cause him to be distracted and it would negatively affect his job performance.
The plaintiff holds Accuquest Hearing Center LLC responsible for allegedly terminating his employment, and denying him equal jobs or benefits despite being qualified to perform his job duties.
The plaintiff requests a trial by jury and seeks injunctive and equitable relief, monetary and punitive damages, prejudgment interest, attorneys' fees, expert witness fees, and for such other legal and equitable relief as the Court may deem just and proper.
