Surviving son accuses Masonic Village at Sewickley of negligence in father's care

PITTSBURGH — A deceased man's son and estate administrator is suing Masonic Homes of the Grand Lodge of Pennsylvania, doing business as Masonic Village at Sewickley, citing alleged failure to protect and negligence.

Robert Mackey Jr. individually and as administrator of the estate of the late Robert Mackey Sr., filed a complaint in the Court of Common Pleas of Allegheny County, alleging that the defendant failed its duty in providing care and services to Robert A. Mackey Sr.

According to the complaint, Mackey Sr. was admitted to the defendant's facility on July 23, 2015. He had been diagnosed with Alzheimer's symbolic dysfunction and hypertension. 

Mackey Jr. claims that although the defendant knew his father was at a high risk for falls, Mackey Sr. allegedly fell numerous times. The lawsuit said Mackey Sr.'s health declined and he died of a heart attack that occurred while he was in the defendant's care. In addition, Mackey Jr. claims the defendant did not update Mackey Sr.'s care plan after the falls and did not update his medical records to include any injuries. 

The plaintiff requests a trial by jury and seeks compensatory, consequential and punitive damages, together with interest, costs of the lawsuit and any other relief the court deems appropriate. He is represented by Scott Simon and Robert Daley of Robert Peirce & Associates PC in Pittsburgh, Pennsylvania.
