Delta Medix claims employees breached contract agreement

SCRANTON — A medical practice is suing Geisinger Health, Ira Kohn, M.D., James L. Stefanelli, M.D., Jerald B. Gilbert, M.D., J. Robert Ramey, M.D., and Brian Kapp, M.D., physicians and shareholder, citing alleged tortious interference and unfair competition.

Delta Medix, PC, filed the complaint on Aug. 14, in the Laredo Division of the Southern District of Texas against the defendants alleging that they breached the contract by engaging or participating in any effort to act to induce Delta's patients, associates, employees, or independent contractor to cease to be a patient of, or other do business with Delta.

According to the complaint, the plaintiff alleges that, in April 2016, Delta Medix, PC plaintiff along with urologist defendants entered into a new employment agreement informing about the non-competition covenants with Geisinger. However, shortly after the agreement, plaintiff learned that urologist defendants allegedly conspired and cooperated with Geisinger to induce Delta staff to terminate their employment with Delta and become employees of Geisinger as well as Delta patients to became patients of Geisinger. 

The plaintiff holds Geisinger Health; Ira Kohn, M.D.; James L. Stefanelli, M.D.; Jerald B. Gilbert, M.D.; J. Robert Ramey, M.D. and Brian Kapp, M.D. responsible because the defendants allegedly made repeated, false material representations to Delta and the Delta Board about their commitments to Delta and failed to inform Delta that they were in talks with Geisinger for employment and were planning on departing Delta without the intention to repay their share of all Delta's outstanding debt.

The plaintiff requests a trial by jury and seeks judgment in an amount to be determined at trial, plus interest, attorneys' fees, costs, and such other and further relief as the Court deems just and proper. They are represented by William A. Harvey of Klehr Harrison Harvey Branzburg in Philadelphia.
