Florida couple files lawsuit after alleged slip-and-fall accident at the Hampton Inn Hotel

SCRANTON — A Florida couple is suing Hilton Worldwide Holdings and Millet Real Estate, claiming injuries in a slip-and-fall accident on a floor that allegedly was slippery.

Kathryn W. Benitz and Agustin R. Benitz filed a complaint on Aug. 21, in the U.S. District Court for the Middle District of Pennsylvania, against the defendants alleging that they failed to ensure that the premises was free from any defects.

According to the complaint, the plaintiffs allege that on Aug. 24, 2016, Kathryn W. Benitz was injured at the Hampton Inn Hotel when she claims that she fell violently due to a soaked and slick floor. 

She claims to have broken her ankle in the fall, suffering pain and scarring and incurring medical expenses. 

The plaintiffs hold Hilton Worldwide Holdings and Millet Real Estate responsible, because the defendants allegedly failed to provide adequate warning of any dangerous artificial conditions and/or to take timely and proper remedial steps to correct the existing danger.

The plaintiffs request a trial by jury and seek damages in excess of the jurisdictional limits of the court, plus costs and attorney's fees.
