Calls from debt collector lead to litigation

PHILADELPHIA — A debt collector faces a class action lawsuit after allegedly repeatedly calling a Honey Brook man's cellphone.  

Richard Huntsman filed a complaint on Aug. 20 in the U.S. District Court for the Eastern District of Pennsylvania against Convergent Outsourcing Inc., alleging violations of the Telephone Consumer Protection Act and the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff received multiple calls from defendant, even after telling the company they had the wrong number. Defendant allegedly made calls using an automatic telephone dialing system, which can violate federal law.

The plaintiff requests a trial by jury and seeks statutory damages of $500 for each negligent violation and $1,500 for each willfull violation of the act, and such other just and proper relief. He is represented by Robert P. Cocco of Robert P. Cocco PC in Philadelphia and David P. Mitchell of Maney & Gordon PA in Tampa.
